Insenia — Terms of Use and End User License Agreement
Last updated: 15 June 2026
These Terms of Use and End User License Agreement ("Terms") govern your access to and use of the Insenia mobile application and related services (the "Service"). Please read them carefully. They include important limitations on liability and, where you are an EU consumer, they do not affect your mandatory statutory rights.
These Terms work alongside our Privacy Policy, which describes in full how we handle your data. Because the Service processes some sensitive ("special-category") information, Section 8 of these Terms also summarises the most important data facts directly, so that nothing important is hidden behind a link.
1. Acceptance and the Parties to This Agreement
1.1 These Terms form a binding agreement between you ("you", "your", or the "user") and Krnic [legal entity name — to confirm], a Belgian company [legal form — to confirm] with registered address at [registered address, Belgium — to confirm], enterprise number [Belgian enterprise (KBO/BCE) number — to confirm] ("Insenia", "we", "us", or "our"). We are the operator and publisher of the Service, and we are the controller for the personal data processed through it.
1.2 By downloading, installing, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
1.3 These Terms govern your use of the Service. How we handle the data we process is described in our Privacy Policy, which is available in the app and athttps://insenia.app/privacyand is incorporated into these Terms by reference (see Section 8 and Section 14). Your acceptance of these Terms is separate from, and does not constitute, any consent we ask for to process special-category data. That explicit consent is requested separately inside the app, is recorded as a separate consent record, and may be withdrawn at any time, independently of these Terms (see Section 8.6).
2. Description of the Service
2.1 Insenia is an evening self-reflection mobile application for iOS and Android. It invites you to complete a short evening ritual and, over time, reflects your own patterns back to you.
2.2 Insenia is designed to be a mirror, not a judge. It does not give advice, it does not score or rate you, and it shows your affect only as colour (for example sage, sand, or terracotta), never as a number or grade. There are no streaks and no guilt mechanics. You are only ever compared to your own baseline, not to other people. The evening ritual is designed never to "fail".
2.3 Insenia is NOT a medical device, a healthcare service, therapy, counselling, diagnosis, treatment, or an emergency or crisis service. See Section 9 for important health and safety information.
2.4Local-first, with some online features.The Service is local-first: the app stores your information on your device as the source of truth, and the core evening ritual can be captured fully offline. Some features need a network connection to work, including: the nightly generation of your question set, the classification and extraction of voice notes (a voice note recorded offline is queued on your device and only processed once you are back online), and your weekly and monthly reflections. A limited subset of derived and profile information is synchronised to our servers, as described in Section 8 and the Privacy Policy.
3. Eligibility and Minimum Age
3.1 You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this minimum age requirement. 16 is the age at which a person can give valid consent to the processing of their personal data under Belgian law.
3.2 The Service is not intended for, and may not be used by, anyone below the minimum age. We ask you to confirm your age during onboarding. We do not knowingly process the data, including the special-category data described in Section 8, of anyone below the minimum age, and we do not have a mechanism to obtain or rely on parental consent. If we learn that a user is below the minimum age, we may suspend or terminate access and we will delete the associated data.
4. Your Account and the Recovery Token
4.1 Insenia uses a pseudonymous, passwordless account model. When you first run the app, it generates a random 256-bit recovery token, which is stored securely on your device (in the iOS Keychain or Android Keystore). From this token the app derives a synthetic, non-identifying account identifier and a matching synthetic email address (of the form<hash>@anon.insenia.app) that is used only to create your account with our authentication provider. At sign-up we do not ask for, and you do not provide, any real email address, name, phone number, or social login.
4.2 The recovery token IS your credential. It is the only thing that authenticates you and the only way to recover your account or move it to another device. You are solely responsible for keeping your recovery token safe and private. Anyone who obtains your token can access your account.
4.3 Because the account is pseudonymous and passwordless, we cannot reset, retrieve, or reconstruct your token for you. If you lose your recovery token and have not set up an alternative recovery method, you will permanently lose access to your account and to any data synced to our servers, and we will not be able to recover it for you. Please note that "pseudonymous" does not mean "anonymous": the data linked to your account is still personal data, and we hold a synthetic account record on our servers that lets the app authenticate you, even though it contains no real-world name, email, or phone number unless you choose to add one.
4.4 You can move your account to another device by importing your recovery token, either by scanning a QR code with your device camera or by entering the token manually.
4.5 Around day 7, the app may optionally invite you to link a real email address solely to provide an additional recovery method. This is entirely optional. If you choose not to link an email, your recovery token remains your only means of recovery.
5. Licence Grant and Store-Specific Terms
5.1 Subject to your compliance with these Terms, Insenia grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the Service on devices that you own or control, for your own personal, non-commercial use.
5.2 You may not copy, modify, distribute, sell, lease, sublicense, reverse-engineer, decompile, or attempt to derive the source code of the Service, except to the extent that such restrictions are prohibited by applicable law.
5.3Apple-required EULA terms.Where you obtain the Service from the Apple App Store, the following additional terms apply and, in the event of any conflict, prevail over other terms in this Section solely to the extent of the conflict:
(a)Acknowledgement.These Terms are concluded between you and Insenia only, and not with Apple. Insenia, not Apple, is solely responsible for the Service and its content.
(b)Scope of licence.The licence granted to you is limited to a non-transferable licence to use the Service on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the Service may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where permitted.
(c)Maintenance and support.Insenia is solely responsible for providing any maintenance and support for the Service. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service. You may direct any maintenance or support questions to Insenia using the contact details in Section 14 ([email protected]).
(d)Warranty.Insenia is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.
(e)Product claims.Insenia, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
(f)Intellectual property rights.In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Insenia, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
(g)Legal compliance.You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
(h)Third-party beneficiary.You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
5.4Google Play.Where you obtain the Service from Google Play, your use is also subject to the Google Play Terms of Service and the usage rules and policies applicable to that store. Google is not a party to these Terms and is not responsible for the Service.
6. Subscriptions and Payments
6.1Free ritual.The core evening reflection ritual is, and will remain, free to use. No payment is required to complete your daily ritual.
6.2Optional subscription.We offer an optional paid subscription ("the deeper picture") that unlocks an additional dashboard and reflective views. The subscription includes a 14-day free trial; the trial ends when the dashboard unlocks.
6.3Billing.Subscriptions are sold and billed through the Apple App Store or Google Play. We manage entitlements on our side through our subscription provider, RevenueCat, which is keyed only to your pseudonymous account reference and to which the app passes no real-world identifying information. Your actual payment is processed by Apple or Google, not by Insenia or RevenueCat. We do not receive or store your payment card details.
6.4Prices.Current prices are shown live in the app as provided by the relevant app store and may vary by region, currency, and over time.
6.5Auto-renewal.Paid subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled. Unless you cancel before the end of the free trial, the subscription will begin and the applicable fee will be charged through your store account.
6.6Cancellation.You can cancel at any time by managing your subscription in your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. Because billing is handled by the app stores, cancellation must be done through the store; we cannot cancel store subscriptions on your behalf.
6.7Restore purchases.If you reinstall the app or move to a new device, you can use the "restore purchases" function to restore an active subscription through your store account.
6.8Refunds.Refunds are handled in accordance with the policies of the Apple App Store or Google Play. Requests for refunds must generally be made through the relevant store.
6.9EU consumer right of withdrawal.If you are a consumer in the EU, you normally have a 14-day right to withdraw from a distance contract for digital content. However, by starting a subscription (including beginning the free trial that unlocks digital content) and consenting to the immediate provision of that digital content before the end of the withdrawal period, you acknowledge that you expressly request immediate performance and accept that you lose your right of withdrawal once performance has begun and the content has been supplied. Nothing in this clause limits any mandatory consumer rights you may have under applicable law, and store-level refund mechanisms remain available as described above.
7. Acceptable Use
7.1 You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
(a) use the Service in any way that violates applicable law or regulation;
(b) attempt to gain unauthorised access to the Service, other users' accounts, or our systems, or to circumvent security or authentication measures;
(c) interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure;
(d) reverse-engineer, decompile, or attempt to extract source code, except where permitted by law;
(e) use automated means to access or scrape the Service, or attempt to misuse the AI processing that supports the Service;
(f) use the Service to upload or transmit content that is unlawful, that infringes the rights of others, or that you do not have the right to submit;
(g) use the Service in any manner that could harm, disable, or impair it, or attempt to use it to make automated decisions about other people.
8. Your Data, Your Content, and How We Process It
This Section summarises the most important data facts. The full detail is in our Privacy Policy athttps://insenia.app/privacy. In case of any inconsistency about data handling, the Privacy Policy governs.
8.1What "user content" and processed data means."User content" means the information you provide or generate through the Service. It includes, but is not limited to: your ritual answers (such as slider and tap values across dimensions like mood/valence, energy, connection, engagement, meaning, and body); your onboarding profile (such as age band, optional biological sex, life phase, household, current concerns, recharge style, a self-rated "day chaos" value, and your chosen reminder time); and any voice notes you choose to record. In addition to the content you provide, the Service generates and processesderived and inferred dataabout you. This includes an inferred psychological profile — including inferred Big Five personality traits, chronotype, stress response, social appetite, recovery style, meaning source, interests, energisers, drainers, aspirations, current concerns, active life events, and your key relationships stored as roles only (never names) — as well as computed behavioural statistics such as weekday mood profiles, baselines, best-day features, day colours, and state snapshots. Your inferred personality profile is used internally and is never shown to you, but we disclose its existence here so that you know it is created.
8.2Special-category (sensitive) data.Some of the data above is "special-category" data under Article 9 GDPR, because it concerns or can reveal information about your health or mental state. Specifically, this includes: your self-reported daily mood/affect and energy; a "health" concern category if you select it; the content of voice notes, which may reveal information about health, grief, or crisis; your inferred personality profile; your optional biological sex; and optional sleep and step data from Apple HealthKit or Android Health Connect. We process this special-category data only on the basis of yourexplicit consent(Article 9(2)(a) GDPR), which we request separately from your acceptance of these Terms (see Section 8.6).
8.3Legal bases.We process your personal data on the following bases: (i)performance of a contract(Article 6(1)(b) GDPR) to provide the Service you have asked for, including creating your account and syncing your data across devices; (ii)your consent(Article 6(1)(a) GDPR) and, for special-category data, yourexplicit consent(Article 9(2)(a) GDPR) for sensitive processing, voice notes, and optional health data; and (iii) ourlegitimate interests(Article 6(1)(f) GDPR) in keeping the Service secure and functioning, where these do not override your rights. The safety screening of voice notes described in Section 9 is also carried out to protect your and others' vital interests.
8.4Your content licence — limited and no AI training.As between you and Insenia, you retain your rights in your user content. You grant us a limited, non-exclusive, royalty-free licence to host, store, process, transmit, and create derived information from your user contentsolely to operate and provide the Service to you, including to generate your reflective content. This licence is limited to what is necessary to provide the Service and is exercised consistently with the Privacy Policy. We do not sell your data, we do not use it for advertising, andwe do not use your user content to train AI or machine-learning models, and our AI sub-processor is contractually bound not to train on or retain it.There is no third-party analytics, tracking, or advertising in the Service.
8.5Voice notes — how they are handled.
(a) Voice notes use your device microphone and on-device speech recognition. When you record a voice note, the resulting transcript is sent to a secure server function first to be screened for safety (see Section 9) and, if it is found safe, to be classified, so that the app can store a short (around 120 characters), anonymised, derived English summary together with a polarity, intensity, and themes.
(b)On-device retention (offline notes).If you record a voice note while offline, the transcript is stored encrypted on your device (using AES-256-GCM, with the key held in your device's secure storage) with a "pending classification" status until you are back online and classification can run. After classification, the raw transcript is removed from your device.
(c)Server-side retention (safe notes).For notes found to be safe, the raw transcript is held on our servers in encrypted form forup to 30 daysand is then permanently purged. Only the short, anonymised derived summary and its metadata are kept beyond that. For notes that trigger a crisis or harm-to-others signal,nothing from the note is stored at all, on the device or on our servers (see Section 9).
8.6Separate, withdrawable consent.Before any special-category processing begins, the app asks for your explicit, freely given consent in a step that is separate from your acceptance of these Terms. We keep a record of that consent. You can withdraw your consent at any time in the app's settings, independently of these Terms. Withdrawing consent stops the relevant future processing and does not affect the lawfulness of processing carried out before withdrawal.
8.7Recipients and sub-processors.To provide the Service, we share data with a small set of processors, each bound to process it only on our instructions:
- Supabase— managed database, authentication, and server functions (hosting region: the European Union (Frankfurt region, eu-central-1), in the EU);
- Anthropic— the AI provider (Claude API), called only from our server functions, never from the app. It performs nightly question-set generation, weekly and monthly reflection generation, the voice-note safety screening (which receives the raw transcript transiently), and voice-note extraction for safe notes. Anthropic is contractually bound not to retain or train on the data;
- Apple— App Store, in-app purchases, push notifications, HealthKit, and iOS speech and Keychain services;
- Google— Google Play, billing, push notifications, Health Connect, and Android speech and Keystore services;
- Expo / EAS— the Expo Push Service used to deliver your evening reminder;
- RevenueCat— subscription-entitlement management, keyed only to your pseudonymous account reference.
8.8International transfers.Our database, authentication, and server functions are hosted in the EU (the European Union (Frankfurt region, eu-central-1)). However, our AI provider, Anthropic, is based in the United States, which means that when a voice-note transcript is screened or when pseudonymous, number-free profile summaries are sent for reflection generation, that data is transferred outside the EU/EEA. These transfers are protected by appropriate safeguards under Chapter V GDPR, namely the European Commission's Standard Contractual Clauses (and any applicable adequacy mechanism), and by Anthropic's contractual commitment not to retain or train on the data. Further detail, including how to obtain a copy of the safeguards, is in the Privacy Policy.
8.9Retention.We keep your synced data for as long as your account exists, so that the Service can reflect your patterns back to you over time. Raw voice-note transcripts on our servers are kept encrypted forup to 30 daysand then purged, as described in Section 8.5. When you delete your account (see Section 11), your data is permanently deleted. Specific retention periods are set out in the Privacy Policy.
8.10On-device-only data.Some data never leaves your device and is never synced to our servers: your optional Apple HealthKit / Android Health Connect sleep and step data (used only with your permission), and raw voice-note transcripts (subject only to the transient, safety-screening flow described above).
8.11Your data-protection rights.Subject to applicable law, you have the right to: access your personal data; rectify inaccurate data; erase your data; restrict or object to certain processing; data portability; and withdraw any consent at any time (see Section 8.6). The app provides built-in tools toexport all of your data as JSONand todelete your account and all associated data(see Section 11), and you can exercise any of these rights by contacting us using the details in Section 14. You also have the right to lodge a complaint with a supervisory authority, in particular theBelgian Data Protection Authority (Gegevensbeschermingsautoriteit / Autorité de protection des données),[email protected], or with the supervisory authority in your country of residence.
8.12No automated decisions with legal effect.The Service does not make any automated decision that produces legal effects concerning you or that similarly significantly affects you (Article 22 GDPR). The reflective content it produces is for personal reflection only.
9. Important Non-Medical and Safety Disclaimer
9.1Insenia is not a medical or therapy service.The Service is a self-reflection tool. It does not provide medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment, and it is not a substitute for professional care. The reflective content it produces is for personal reflection only.
9.2 If you have or think you may have a medical or mental-health condition, always seek the advice of a qualified health professional. Never disregard professional advice or delay seeking it because of something you read or saw in the Service.
9.3Crisis tooling is not an emergency service.As a safety feature, every voice note is first screened by an automated safety classifier before anything is stored. If signs of crisis (such as self-harm, suicide, or hopelessness) or harm to others are detected, nothing from that note is stored anywhere, and a pre-written, region-local helpline support screen is shown (which works offline). This screen is informational only. Please be aware that a voice note recorded while you are offline is only screened once you are back online, so any crisis signal in an offline note will not be detected until then. Insenia is not an emergency service, does not monitor users in real time, and cannot and does not guarantee that any crisis signal will be detected or acted upon.If you are in danger or in crisis, or if you think someone's life is at risk, contact your local emergency services or a crisis helpline immediately.
10. Disclaimer of Warranties and Limitation of Liability
10.1As-is.To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any reflective content will be accurate, useful, or suitable for any particular purpose.
10.2Limitation of liability.To the maximum extent permitted by applicable law, Insenia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, the Service.
10.3EU consumer carve-out.Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. In particular, nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any liability that cannot be excluded or limited under applicable mandatory law. If you are a consumer, you have statutory rights that these Terms do not affect, and your mandatory consumer-protection rights under the law of your country of residence continue to apply.
11. Termination and Effect
11.1 You may stop using the Service at any time. You may delete your account and all associated data at any time using the in-app "Delete my account and all data" function, which requires a double confirmation. This permanently and irreversibly deletes your data from our servers (via authenticated cascade deletion), wipes the local data on your device, and removes the recovery token from your device's secure storage.
11.2 We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if necessary to protect the Service or other users.
11.3 On termination, the licence granted in Section 5 ends. Deletion of your account is irreversible: once your recovery token is removed and your data is deleted, it cannot be recovered. Provisions that by their nature should survive termination (including Sections 8, 9, 10, and 13) will survive.
12. Changes to the Service and to These Terms
12.1 We may modify, update, suspend, or discontinue all or part of the Service at any time, including features of the optional subscription, in accordance with applicable law.
12.2 We may update these Terms from time to time. If we make material changes, we will take reasonable steps to inform you, for example through the app. Changes take effect when posted unless stated otherwise. If you do not agree to the updated Terms, you should stop using the Service. Where required by law, material changes adverse to consumers will not apply retroactively and your continued statutory rights are preserved.
13. Governing Law, Mandatory Consumer Rights, and Complaints
13.1 These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of Belgium, without regard to conflict-of-laws rules.
13.2Mandatory consumer law.If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection afforded by the mandatory provisions of consumer-protection law of the country in which you habitually reside, and you may also bring proceedings in the courts of that country where mandatory law so provides.
13.3Complaints and dispute resolution.If you have a complaint, please first contact us using the details in Section 14 so we can try to resolve it. If you are an EU consumer, you may also have access to out-of-court dispute resolution. You can contact the relevant national consumer mediation or alternative dispute resolution body, and information about online dispute resolution for consumers is available through the European Commission's resources. Use of these routes does not affect your right to bring a claim before a competent court, nor your right to complain to a data-protection supervisory authority as described in Section 8.11.
